1. Background
The Pacific Lottery Network website (PLN Website) is owned and operated by TMS. The PLN Website is the medium through which you, as a PLN Player, can check your tickets (Entries) and claim your prizes.
This Policy applies to PLN Players who interact with the PLN Website and TMS. The terms ‘we’, ‘us’ or ‘our’ refers to TMS. The use of the term ‘you’ refers to you as a PLN Player.
This Policy provides an overview of how we collect, store, and use Personal Information. This Policy also details how you can access and update your Personal Information or make a complaint.
We are committed to the protection of the Personal Information of individuals, and to maintaining the highest possible standards of privacy. We seek to implement practices, procedures, and systems that comply with Privacy Legislation.
By providing Personal Information to us, you consent to our collection, use and disclosure of your Personal Information in accordance with this Privacy Policy and any other arrangements that apply between us.
2. Definitions
AML/CTF Act means the Anti Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) or other applicable legislation in the relevant PLN Territory;
Entry means an entry in a game of OzLotto, Powerball or TattsLotto;
Personal Information is any information about you that identifies you or by which your identity can be reasonably determined;
PLN Agent means a duly-authorised reseller of Entries appointed by TMS;
PLN Player means a person who purchases an Entry from a PLN Agent;
PLN Territory means Fiji, Samoa, Nauru, Norfolk Island, Cook Islands and Christmas Island;
PLN Website means the website located at www.pacificlotterynetwork.com;
Privacy Legislation means the privacy legislation applicable to (a) the PLN Territory in which you are resident or from where you purchased your Entry and (b) the provision of your Personal Information to TMS and the PLN Agent in your PLN Territory;
TMS means TMS Global Services Pty Ltd (ABN 22 089 771 835) on behalf of itself and other relevant entities in the Jumbo Interactive Limited (ABN 66 009 189 128) group of companies, including TMS Global Services (Vic) Pty Ltd (ABN 82 113 337 358) and TMS (Fiji) Pte Limited.
3. What Personal Information do we collect and hold?
This Policy applies to Personal Information. What Personal Information we collect, and hold will depend upon the nature of your dealings with us as well as the requirement of applicable laws, regulations, and licence conditions. We may collect, for example, the following Personal Information:
- Name
- Date of birth
- Mailing address
- Email address
- Telephone number
- Financial institution account details
- Credit card details
- Signature
- Information on identity verification documents which we require for account registration
- Usernames and passwords for your account
We may also collect non-personal information, which does not identify you as an individual, for analytical purposes. This information may include, for example, when you visit the PLN Website, your internet protocol (IP) address and user information in an aggregate, non-personal, format for statistical and research purposes. This information may be used if requested by government agencies, regulatory bodies or under TMS’s contractual obligations with third parties.
4. Why and how we collect Personal Information
We may use Personal Information collected from you to:
- Verify your identity;
- Record and register your lottery purchases and other transactions with us and manage accounts held with us;
- Notify you of, and provide you with, any lottery winnings;
- Conduct appropriate checks to protect against fraud;
- Address any query, feedback, or complaints you may have; and
- Respond to any enquiries from any government or regulatory authority required or authorised by law (for example under the AML/CTF Act).
This list is not exhaustive and there may be other reasons we are required to use your Personal Information in order to provide our services.
What are ‘cookies’?
- Our website uses ‘cookies’.
- ‘Cookies’ are alphanumeric identifiers that are placed on your computer’s hard drive through your web browser.
- ‘Cookies’ enable our system to recognise your browser and maintain your purchasing details in your shopping basket. They also allow us to track the user across multiple sessions for analytical purposes

- We recommend that you leave your ‘cookies’ enabled; otherwise you may have difficulty trying to purchase lottery entries with us.
- Our ‘cookies’ don’t send us back any information about your computer (except your IP address) or any other information on your hard drive.
5. Use and disclosure of Personal information
We collect Personal Information for the purpose of administering lottery based gaming activities, ensuring PLN Players who win prizes receive their winnings and helping improve the services we provide.
If you win a prize, we will not publish or disclose your identity to any third parties without your explicit prior consent, unless otherwise permitted under the terms and conditions of your Entry purchase.
We may provide Personal Information, data and statistics about PLN Players, our sales, and any related website information to reputable third parties. This information is used for business purposes (for example for analytical purposes).
6. Personal Information Security
We are committed to the protection of PLN Players’ Personal Information from unauthorized access. We use a range of security mechanisms and procedures to protect the Personal Information we hold.
We make all reasonable efforts to ensure your Personal Information is stored securely both in electronic and physical forms and comply with Privacy Legislation. However, there may be risks associated when transferring your Personal Information to us from other internet facilities or by email.
Personal Information that is no longer required will be destroyed in accordance with Privacy Legislation. We will take all reasonable steps to ensure that any third-party organisations we deal with are bound by confidentiality and privacy obligations in relation to the protection of PLN Players’ Personal Information.
7. Important Notice: cross-border disclosures
By providing your Personal Information to us, you consent to disclosures to TMS in Australia and to other third parties who may be located outside of your PLN Territory. That third party may store your Personal Information but are not permitted to re-sell, use, or share your Personal Information without our permission.
We will take reasonable steps to ensure that any overseas third party recipients take steps to protect your privacy. However, you acknowledge that we will not be accountable under Privacy Legislation for any breach of your privacy by the overseas recipient, nor will you be able to seek redress under Privacy Legislation for any use or breach by the overseas recipient. You also acknowledge that the overseas recipient may not be subject to similar laws or principles as under Australian privacy law or the privacy laws in your PLN Territory.
8. Access to Personal Information
You may have the right under Privacy Legislation to seek access to the Personal Information held about you. If you wish to exercise this right, or if you believe that the information is incorrect, incomplete or out-of-date, you should contact us at support@pacificlotterynetwork.com.
All requests to access Personal Information must be made in writing or by email and addressed to the Privacy Officer at the addresses listed at the end of this document. It is our policy to respond to any such request within a reasonable period of time after the request is received. We will not charge you for making requests to access any information held about you, however, we reserve the right to undertake cost recovery for the provision of such information where it is justified.
If there is a reason for not granting you access to your information, we will provide you with a written explanation of the reasons for the refusal (unless unreasonable to do so) and inform you of the mechanisms to complain about the refusal.
9. Enquiries and Complaints
If you have a complaint regarding our management of your Personal Information, wish to correct information held by us or require further information, please contact us. Our policy is to respond to your complaint, correction request or query within a reasonable period of time after the complaint is received.
If you are not satisfied with the outcome of your complaint, you may refer your complaint to the privacy ombudsman in your PLN Territory, if any. For PLN Players resident in Norfolk Island or Christmas Island, the privacy ombudsman is the Office of the Australian Information Commissioner, contactable on 300 363 992 or by visiting the website www.oaic.gov.au.
10. Updates to the Privacy Policy
We reserve the right to make changes to this Privacy Policy. Any changes made to the Privacy Policy in the future will be posted on this page and such changes will become effective upon posting of the revised Privacy Policy. We encourage you to review this Privacy Policy each time you visit the PLN Website before providing any Personal Information to ensure you are aware of the terms.
